Terms of Use — Orcinos

Orcinos Chat Oplix — Traffic Intelligence Motiq — Drive AI

1. Acceptance of Terms

By accessing or using any Orcinos product — including Orcinos Chat, Oplix, and Motiq — you agree to be bound by these Terms of Use. If you do not agree, do not use the platform.

These terms form a legally binding agreement between you and Prisca Dezigns, the operator of the Orcinos platform, based in Trinidad and Tobago.

2. Eligibility

You must be at least 18 years of age to create an account and use Orcinos products. By registering, you confirm that you meet this requirement. Accounts created on behalf of a business must be authorized by that business.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at hello@priscadezigns.org if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or cause harm to the platform or other users.

4. Permitted Use

Orcinos products are licensed to you for lawful, personal, or business use in accordance with these terms. You may:

Use Orcinos Chat for AI-assisted productivity and information tasks
Use Oplix to monitor traffic and infrastructure on property you own or are authorized to surveil
Use Motiq to record and analyze footage from your own vehicle

5. Prohibited Use

You may not use any Orcinos product to:

Surveil, track, or record individuals without their knowledge or consent where required by law
Collect, store, or transmit personally identifiable information of third parties without authorization
Violate any applicable law in Trinidad and Tobago or your jurisdiction
Reverse-engineer, decompile, or attempt to extract source code from any Orcinos product
Overload, disrupt, or attempt to gain unauthorized access to our infrastructure
Use AI outputs to harass, defame, or harm individuals or organizations
Resell, sublicense, or redistribute Orcinos access without express written permission

Important: Oplix and Motiq involve camera-based AI. You are solely responsible for ensuring your deployments comply with all applicable privacy, surveillance, and data protection laws. Orcinos provides the technology — the legal responsibility for how you deploy it rests with you.

6. AI-Generated Content

Orcinos products use artificial intelligence models. Outputs — whether from Chat, Oplix detections, or Motiq analysis — are generated by automated systems and may contain errors.

Do not rely solely on AI outputs for legal, medical, financial, or safety-critical decisions
AI detections from Oplix and Motiq are informational — they do not constitute official enforcement records
You are responsible for verifying any AI-generated output before acting on it

AI Training Loop: To improve detection accuracy for Caribbean road conditions, anonymized and aggregated data from Oplix and Motiq sessions may be used to refine our AI models. No personally identifiable information is used in this process. You may opt out by contacting us.

7. Dashcam & Camera Data (Motiq and Oplix)

Motiq

Video processed through Motiq is handled locally on your device. When you choose to upload a clip, it is transmitted to our secure servers for AI analysis and storage. You retain ownership of your footage. You grant Orcinos a limited, non-exclusive license to process and analyze that footage solely for the purpose of delivering the Motiq service to you.

Oplix

Oplix connects to IP camera streams you provide access to. You confirm that you are authorized to access and analyze those streams. Event frames captured by Oplix remain your property. Orcinos processes them only to deliver detection results and improve accuracy with your consent.

8. Intellectual Property

All Orcinos branding, software, UI design, and underlying AI infrastructure are the intellectual property of Prisca Dezigns. Nothing in these terms transfers ownership of that IP to you.

Content you create or upload — your footage, your configurations, your data — remains yours. You grant us only the permissions necessary to operate the service as described.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, release updates, or temporarily suspend features. We are not liable for losses resulting from service downtime.

We reserve the right to modify, discontinue, or introduce pricing for any Orcinos product with reasonable notice.

10. Limitation of Liability

To the fullest extent permitted by law, Prisca Dezigns and the Orcinos platform are not liable for:

Indirect, incidental, or consequential damages arising from your use of the platform
Decisions made based on AI-generated outputs
Data loss, unauthorized access, or security breaches outside our reasonable control
Third-party actions or services connected to your Orcinos deployment

Our total liability for any claim arising from these terms shall not exceed the amount you paid to Orcinos in the 30 days preceding the claim.

11. Governing Law

These Terms of Use are governed by the laws of the Republic of Trinidad and Tobago. Any disputes shall be resolved in the courts of Trinidad and Tobago, unless otherwise agreed in writing.

12. Changes to These Terms

We may update these Terms of Use as the platform evolves. We will notify registered users of material changes by email and update the effective date above. Continued use of Orcinos after changes take effect constitutes acceptance of the revised terms.
